Terms Of Use Of The Platform

PropriX AG

Access to and use of the PropriX platform are governed, as applicable from time to time, by these Terms of Use (the “Terms of Use”), together with the General Terms and Conditions, the Data Protection Notice, the Cookie Policy and the Data Processing Agreement.

Applicability And Legal Information

By accessing this Platform and its pages, the user declares that they have read, understood and agree to comply with the present rules of use and the related legal information applicable to this Platform (and to the elements contained therein). If the user does not agree with the Terms of Use, they must refrain from accessing or using the Platform and its pages.

It is the user’s responsibility to verify that they are not subject to any legislation that restricts or prohibits access to, navigation on, use of, or publication on the Platform. If the user is subject to such restrictions due to their nationality, residence, domicile or for any other reason, it is their sole responsibility to refrain from using the Platform.

These Terms of Use, together with the General Terms and Conditions and the Data Processing Agreement, form an integral part of the Service Agreement concluded with PropriX.

Intellectual Property

All elements made available on the Platform, including but not limited to information, data, images and layout, are the exclusive property of PropriX, unless expressly stated otherwise.

Subject to the provisions of the Service Agreement applicable to users who purchase PropriX services, the data, elements and information made available on the Platform may be used free of charge exclusively for private use. By accessing the Platform, the user expressly undertakes not to copy, publish, distribute or otherwise make available to third parties any data, elements or information contained on the Platform, unless prior written consent has been obtained from PropriX.

PropriX does not grant any licence or usage rights with respect to images, trademarks or logos displayed on the Platform, which remain the full and exclusive property of PropriX.

Any images, trademarks, logos or designations of third parties displayed on individual landing pages remain the property of their respective owners.

Offers

The information published on the Platform does not constitute an invitation to make an offer, nor an offer, nor a recommendation relating to the leasing, purchase or sale of real estate, nor the execution of transactions of any other kind, nor legal, tax or financial advice. Any use of the Platform and any decisions taken by the user on the basis thereof are the sole responsibility of the user.

Warranty And Liability

PropriX does not warrant that the properties presented on the landing pages are still available, nor does it provide any warranty of any kind in relation to such properties.

Although PropriX endeavours to ensure that the data and information published on the Platform are accurate, complete and up to date at the time of publication, no express or implied warranty is given in this respect.

Furthermore, PropriX does not warrant that the Platform’s functionalities will be uninterrupted, error-free or continuously available.

Any liability of PropriX for damages arising from access to or use of the Platform, or from the inability to access or use the Platform, is expressly excluded, to the extent permitted by applicable Swiss law.

Note on legal equivalence (Swiss law): The exclusion of liability is drafted in accordance with Articles 97 et seq. of the Swiss Code of Obligations and is intended to apply only to the extent legally permissible. Mandatory liability under Swiss law (e.g. for intent or gross negligence) remains unaffected.

Links To Third-Party Websites

The Platform may contain links to third-party websites. PropriX assumes no responsibility for the content of such websites. Access to third-party websites via such links is at the user’s own risk.

Amendments

PropriX reserves the right to amend these Terms of Use at any time.

The version published on the Platform at the time of use shall be deemed the valid and binding version vis-à-vis the user. Users are therefore encouraged to consult this section of the Platform regularly.
